Yesterday, High Court judge and head of the Justice Appointments Council (KED) Adrian Broci failed his vetting and was dismissed.
The judicial body that announced the ruling consisted of Etleda Çiftja, Xhensila Pine dhe Valbona Sanxhaktari.
Several discrepancies were found in the judge’s real estate declarations.
In 2013, Broci expanded his Tirana apartment. The Independent Qualification Commission (KPK) found inconsistencies when comparing the surface areas and the amounts of money cited in the judge’s annual wealth declarations to his vetting wealth declarations.
The judge claimed as a source of income for the expansion of another apartment, the sale of a beach house. This expansion was made in 2011, but it was declared in 2103. In this case, as well, KPK found discrepancies with the declarations when compared to bank transactions.
In 2014, Broci reviewed a civil case in which the defendant was the construction company that built a building in which the judge owns an apartment. Broci ruled in favor of the company, deeming that it didn’t have to pay damages to the plaintiffs. In this case, KPK ruled that the judge had an outstanding conflict of interest.
For another apartment, located in Rrushbull, there exist two different notary declarations, casting doubt on the authenticity of both of them. The judge filed no documentation proving that he paid taxes related to the sale of this property.
KPK also concluded that the judge did not have income sources to justify the purchase of a 40 square meter office in Tirana. This property has been rented for three years but the information regarding the profit it generates is contradictory.
In the case of another 63 square meter property in the Shallvare area, Broci failed to declare the rent and there are tax discrepancies for multiple years.
Furthermore, KPK concluded that the judge also failed to declare a property under his use in Rruga e Dibrës, after the energy company OShEE reported that Broci’s name is connected to a utilities contract.
Artan Broci is the fourth High Court judge that fails the vetting. KPK has already dismissed judges Admir Thanza, Artan Zeneli, ang Shkëlzen Selimi.
