Today, the Appeal Chamber ruled that the vetting process of former General Prosecutor Adriatik Llalla will not continue.
The College dismissed the request of Public Commissioner Florian Ballhysa and upheld the Independent Qualification Commission (KPK) ruling to interrupt Llalla’s vetting, when the latter resigned in February 2018.
With a majority of votes, the College of Appeals decided that: the process of reassessment for Adriatik Llalla will be interrupted. He is prohibited from being appointed as judge, prosecutor, or member of the High Judicial Council (KLD) for 15 years.
As Exit has explained before, Adriatik Llalla decided to leave the judiciary system and refused to exercise his right to return to the Appeals level following his term’s end. On February 10, Llalla announced his retirement from the judiciary system via a letter to President Ilir Meta.
In response to Adriatik Llalla’s decision, the KPK decided on February 16, 2018 to interrupt the former’s vetting process.
KPK based its decision on article G of the Annex to the Constitution that states: “the assessee may resign from the office and is not assessed any further.” as well as article 56 of Law no. 84/2016 “On the Transitional Re-Evaluation of Judges and Prosecutors” that states: “ In case of resignation, the Commission shall issue a decision on the cessation of the re-evaluation procedure.”
