Appeals Chamber Offers No Solution To Prosecutors Appealing Their Suspension

On Thursday, the Special Appeals Chamber (KPA) declared itself incompetent to handle the complaint filed by prosecutors Rovena Gashi and Dritan Gina regarding the decision of Temporary General Prosecutor Arta Marku to suspend the both of them.

According to KPA, the two suspended prosecutors must appeal Marku’s decision at the Administrative Appeals Court.

With this ruling, the KPA also demonstrated that Arta Marku misled the two prosecutors with their suspension documentation, where it was stated that the decision could be appealed at the Special Appeals Chamber.

The events so far

On May 11, 2018, Temporary General Prosecutor Arta Marku decided to suspend prosecutors Rovena Gashi and Dritan Gina, arguing that the couple were being investigated by the Durrës Prosecution Office.

Verdicts no. 140 and 141, dated May 11 and signed by Arta Marku, state that in order to appeal the decision, the prosecutors may “turn to the Special Appeals Chamber.”

In June, Gashi and Gina appealed Marku’s ruling at the Special Appeals Chamber.

On July 5, the Special Appeals Chamber replied to Gashi and Gina’s complaints by refusing to take responsibility for reviewing the Temporary General Prosecutor’s decision. KPA pointed the prosecutors towards the Administrative Appeals Court, contradicting Marku’s ruling.
