Opposition leader Luzlim Basha stated that the ruling majority is pursuing a coup against the Constitution by the way it’s appointing members to the Constitutional Court.
He said the majority is trying to turn the Constitutional Court into a marionette in its hands:
“What is now happening with the Constitutional Court is a clear institutional coup. It is a constitutional coup, which aims at giving citizens a Constitutional Court, steps for the forming of which have been ongoing for years, that is a marionette of the regime.”
Basha went on saying that the Socialist Party fears an independent Constitutional Court because it has been passing several unconstitutional laws in attempts to legalize its corruptive affairs, like the law for the expropriation of lands by the seaside, or the creation of the Albanian Investment Corporation. He added that an independent judiciary would criminally charge the prime minister and his minister for violating basic rights of Albanians.
The leader of the Democratic Party said that Prime Minister Edi Rama and his Socialist Party “have captured all powers”, and now they are trying to “cement” their grab. The government “does not want a reformed judicial system,” Basha argued.
His comments came after the constitutional crisis and institutional chaos regarding the appointment of members of the Constitutional Court.
One of the members, Arta Vorpsi, took her oath in front of a notary and sent a copy of it to the President. According to Constitution art. 129, all new members of the Constitutional Court need to take an oath before the President, and there is Constitutional Court jurisprudence that without such an oath members are not allowed to exercise their duty.
