The election process for the next General Prosecutor has suffered further delays as one of the applicants, lawyer Lulzim Alushaj, has filed a lawsuit against the High Prosecutorial Council’s (KLP) decision to exclude him from the race.
According to the Regulations governing the election of the General Prosecutor, the “Council doesn’t take any further action until the end of the complaint process or actions of the Administrative Appeals Court.” According to art. 31 of the Prosecution Law the Court will have 7 days to adjudicate the case.
A few days ago, Alushaj was excluded from the candidate list based on the fact that he didn’t fulfill the requirement of 15 years of experience.
It is unclear how the KLP will act if the Administrative Appeals Court will decide in Alushaj’s favor. The KLP is expected to draft a list of three candidates for the function of General Prosecutor, from which the Parliament will elect one. As there are, including Alushaj, four candidates, the chances are considerable he will still be left off the final list. The other candidates are current Temporary General Prosecutor Arta Marku, Olsian Çela, and Fatjona Memçaj.
