KPK Violates Vetting Law Deadlines

Over the summer, the Independent Qualification Commission (KPK) has failed to publish many of its verdicts taken before the summer recess. According to the Law 84/2016 “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania” (Vetting Law) art. 55(7), “the written decision shall be notified to to the public commissioner and international observers with 30 days after the end of the hearing [and] published on the Commission’s website.”

This means that as of today, all decisions prior to August 5 should have been published on the KPK website. 18 verdicts continue to unpublished, despite the deadlines set by the Vetting Law. As a result, also possible appeals by the Public Commissioner and assessees have been delayed. According to Vetting Law art. 63(1) an appeal can be filed at the Special Appeals Chamber (KPA) within 15 days after the notification by the KPK. Delays of the KPK notifications thus lead to a further delay in the appeals, and therefore, the vetting as a whole.
