Parliament will meet in an extraordinary session today at 10 o’clock to approve a draft resolution calling President Ilir Meta’s decree of November 13, 2019, to appoint Marsida Xhaferllari to the Constitutional Court “absolutely invalid,” which basically means a request to all state institutions to ignore her appointment.
Xhaferllari took the oath of office in front of the President yesterday.
As with President Meta’s decree to invalidate his decree for the June 30 elections, the only institution that appears to be able to judge whether his decree to appoint Xhaferllari indeed is “absolutely invalid” is paradoxically the Constitutional Court itself, of which Xhaferllari now is officially a part.
The draft resolution, however, calls upon all state institutions, including the Constitutional Court, to accept Arta Vorpsi instead. Vorpsi swore herself in in front of a notary in Tirana. It is, of course, completely clear how this will work out in practice.
Furthermore, the draft resolution ends with Parliament expression its intention “engage in revising the legislation to prevent the future creation of situations that in an abusive way block the functioning of the constitutional organs of the country.” This statement appears to point at a constitutional reform.
Should the draft resolution be adopted, the entire establishment of a new Constitutional Court will be blocked, with no perspective on a feasible solution.
