No matter which decision the Council of Mandates will take today in relation to the request of the Prosecution to allow the arrest of Saimir Tahiri, the investigation of Tahiri in the Habilaj case will continue.
The authorization for the the removal of the immunity of a deputy by Parliament is not necessary for the continuation of the prosecution’s investigation, but only for the arrest of the deputy.
The parliamentary approval of the legal package for the judicial reform should have led to the establishment of the Special Prosecution, which would investigate all cases of corruption and organized crime, as well as accusations against high officials. All these criteria are fulfilled by Saimir Tahiri: he is accused by the prosecution of “trafficking of narcotics” in collaboration with a criminal organization and “passive corruption of high state officials and local elected officials.”
However, since art. 4 of the law “For the organization and functioning of institutions to fight corruption and organized crime” envisions that the special prosecutors of SPAK are nominated by the High Prosecutorial Council (KLP), which still has not started its work, the case of Tahiri will be investigated by the Prosecution of Serious Crimes.
