Yesterday, the Appeals Chamber decided to postpone the Public Commissioner’s hearing appealing the Independent Qualification Commission (KPK) ruling to interrupt the vetting of former General Prosecutor Adriatik Llalla to June 6.
The judiciary body, made up of Ina Rama, Sokol Çomo, Albana Shtylla, Ardian Hajdari and Luan Daci, decided to consider as evidence Llalla’s resignation and his release from duty at the end of his term, in December 2017.
The Public Commissioner and Llalla’s defense attorney have been given time until June 6 to prepare their final statements.
The June 6 hearing will be the third hearing of the case, following that of May 16 and May 31.
Adriatik Llalla decided to leave the judiciary system and refused to exercise his right to return to the Appeals level following his term’s end. On February 10, Llalla announced his retirement from the judiciary system via a letter to President Ilir Meta.
In response to Adriatik Llalla’s decision, the KPK decided on February 16, 2018 to interrupt the former’s vetting process.
KPK based its decision on article G of the Annex to the Constitution that states: “the assessee may resign from the office and is not assessed any further.” as well as article 56 of Law no. 84/2016 “On the Transitional Re-Evaluation of Judges and Prosecutors” that states: “ In case of resignation, the Commission shall issue a decision on the cessation of the re-evaluation procedure.”
Contrary to what the law provides, the Public Commissioner decided to appeal KPK’s decision, on March 27, 2018, 39 days after the decision was announced, and 24 days after the legal deadline had passed.
