In the last three years of the vetting process, the International Monitoring Operation (ONM) has recommended the dismissal of 12 magistrates who passed vetting in the first instance.
The first ONM recommendation was filed on 13 July 2018 against the former President of the Constitutional Court, Bashkim Dedja; the last one was against Administrative Appeals Court Judge Alkelina Gazidede.
The ONM can make recommendations, which are then taken into consideration or dismissed by the Public Commissioner, who has the right to appeal a vetting case.
Of the 12 ONM recommendations for dismissal of judges and prosecutors, the Public Commissioner has appealed 11 cases and dismissed one. The Special Appeals Chamber (KPA) dismissed six of the magistrates recommended by the ONM, while five of them are awaiting a final verdict.
The KPA confirmed a magistrate following the Public Commissioner’s withdrawal from the case.
