The Next Steps in Judicial Reform – Exit Explains

Yesterday evening, Parliament approved the opposition members of the three parliamentary ad-hoc committees that will select the members of the three vetting institutions, the Independent Qualification Commission (KPK), the Appeals College (KA), and the Public Commissioners. The committee members from the majority had been approved a month ago.

The first ad-hoc committee, consisting of 3 majority and 3 opposition members, will compile the final list of vetting institution candidates from which the other two ad-hoc committees will make their final selection. The committee consists of the following six members:

  1. Ulsi Manja (PS)
  2. Vasilika Hysi (PS)
  3. Luan Rama (LSI)
  4. Oerd Bylykbashi (PD)
  5. Flamur Noka (PD)
  6. Fatmir Mediu (PR)

According to the Constitution, the first ad-hoc committee has 10 days to compile the list.

The National Ombudsman already returned the three lists with qualifying candidates, non-qualifying candidates, and International Monitoring Mission (ONM) recommendations to Parliament, which means that the first ad-hoc committee can immediately start its work.

The National Ombudsman found that 84 applicants formally qualify, while 109 did not fulfill the formal criteria. Of the 84 applicants, the ONM gave a negative recommendation to 17, which leaves a minimum of 67 applicants on the final list of candidates. The first ad-hoc committee can move non-qualifying applicants to the final list with a majority of votes.

Once the first ad-hoc committee has finished its work, the other two ad-hoc committees will have to choose the final 27 vetting institution members within thirty days after May 22, that is on June 21 latest.

Second ad-hoc committee, selecting members of the KPK and the Public Commissioners:

  6. Mesila Doda (PDIU)

  11. Jorida Tabaku (PD)
  12. Aldo Bumçi (PD)

Third ad-hoc committee, selecting members of the KA:

  1. Vasilika Hysi (PS)
  2. Ervin Bushati (PS)
  3. Vangjel Tavo (LSI)
  4. Eduard Halimi (PD)
  5. Flamur Noka (PD)
  6. Albana Vokshi (PD)

The second and third ad-hoc committees will have a difficult task, as following the procedures lined out in the Constitution significantly lower the chances of a successful election.

It is therefore expected that if all constitutional deadlines are respected, the vetting institutions will be functional before the elections of June 25.
