The Parliamentary Assembly of the Council of Europe is expected to vote tomorrow during its plenary session on the Albanian judge at the European Court of Human Rights (ECtHR) in Strasbourg.
Last week, the Committee on the Election of Judges to the European Court of Human Rights proposed Darian Pavli, who has no prior experience as judge, to replace Ledi Bianku whose term has ended.
The incoming judge will be quickly faced with several important cases, including the suit filed by Prosecutors Rovena Gashi and Dritan Gina against their suspension by Temporary General Prosecutor Arta Marku. A verdict in this case could have serious implications for the entire justice reform.
As Pavli is currently senior legal advisor at controversial EURALIUS V mission, which advises on the justice reform, it remains an open question whether he should recuse himself because of a potential conflict of interest, should he be elected judge.
