President Ilir Meta has decreed the first new member of the Constitutional Court, Besnik Muçi. President Meta chose from a list provided by the Justice Appointment Council (KED), further containing the names of Arta Vorpsi, Elsa Toska, and Regleta Panajoti. Muçi was ranked third on the list. Muçi will join Vitore Tusha, until recently the only remaining judge at the Constitutional Court, whose term has officially already ended.
In his decree, President Meta argued that one of the main consideration for electing Muçi was that he was the only candidate from any of the f0ur lists drafted by the KED who comes from the ranks of the Prosecution.
Muçi, a prosecutor at the Serious Crimes Prosecution Office, was confirmed by the Independent Qualification Commission (KPK) on July 30, 2018, but his confirmation was appealed by the Public Commissioner. The Special Appeal Chamber was expected to hold a hearing, which, however, was postponed to today, 12:00. If Muçi is eventually dismissed by the KPA, he will lose his position at the Constitutional Court he just acquired.
The possibility to nominate an unvetted candidate to the Constitutional Court is the direct result of the decision of the KED not to await the final decision of the vetting institutions for candidates to the Constitutional Court.
With the election of Muçi, another candidate for the Special Prosecution Office SPAK has been eliminated, after the dismissal by the KPK of Ndini Tavani. Muçi was ranked last on the candidate list compiled by the High Prosecutorial Council (KLP).
